Grounds of Deportation


The grounds of deportability are outlined in the Immigration and Nationality Act ("INA") at section 237(a). In order for an individual to be charged with a ground of deportability under INA § 237(a), the individual must have been admitted to the U.S. as defined in INA § 101(a)(13). On the other hand, individuals who have not been "admitted" to the U.S. and are alleged to have violated immigration law(s) are charged under the grounds of inadmissibility, which are outlined under INA § 212(a). The following is a list of the most common grounds of deportability:

Inadmissible at the Time of Entry or Adjustment of Status

  • Inadmissible - INA § 237(a)(1)(A)
  • Present in Violation of Law - INA § 237(a)(1)(B)
  • Violation of Status - INA § 237(a)(1)(C)
  • Termination of Conditional Permanent Residence - INA § 237(a)(1)(D)
  • Smuggling - INA § 237(a)(1)(E)
  • Marriage Fraud - INA § 237(a)(1)(G)

Criminal

  •  Crimes Involving Moral Turpitude (CIMT) - INA § 237(a)(2)(A)(i)
  • Multiple Criminal Convictions - INA § 237(a)(2)(A)(ii)
  • Aggravated Felony - INA § 237(a)(2)(A)(iii)
  • Controlled Substances Convictions - INA § 237(a)(2)(B)(i)
  • Drug Abusers and Addicts - INA § 237(a)(2)(B)(ii)
  • Certain Firearm Violations - INA § 237(a)(2)(C)
